Case against LUTH by NANNM decided

Judgement was delivered today by Hon. Justice Obaseki-Osagie of the National Industrial Court, Ikoyi, Lagos in the case brought before it by:

1. National Association of Nigerian Nurses and Midwives (NANNM)

2. NANNM (Lagos State Council) and

3. NANNM (LUTH Branch)

against

1. Lagos University Teaching Hospital (LUTH) Management Board

2. LUTH

3. CMD LUTH

4. Federal Ministry of Health and

5. Head of the Civil Service of the Federation.

The court held that:

1. That the strike embarked upon by the Nurses is illegal being staff employed in an essential service who are required to give a mandatory 15 days notice which they failed to give.

2. They are not entitled to be paid for the period for which they were on strike

3. That the non-promotion of Nurses who do not have BSc to directorate level is lawful and non-discriminatory as it is in line with the Scheme of Service and approved by the National Council of Establishments and applies to all cadres in the public service.

4. That non-remittance of their check-off dues was unlawful.
